Welcome to Kinematek Enterprise LLC. These Terms of Service (“Terms”) govern your access to and use of Kinematek.com (the “Site”) and your purchase or use of products offered by Kinematek Enterprise LLC (“Kinematek,” “we,” “us,” or “our”).
By accessing the Site or purchasing products from us, you agree to these Terms. If you do not agree with these Terms, please do not use the Site or purchase our products.
You may use the Site for lawful purposes and in accordance with these Terms.

We reserve the right to restrict or terminate access to the Site for users who violate these Terms.
Kinematek offers physical products, including phone cases and accessories, as well as digital products such as downloadable files, CAD resources, tutorials, and other digital content.
We make reasonable efforts to ensure that product descriptions, images, specifications, colors, dimensions, weights, and other information displayed on the Site are accurate. However, minor variations may occur, particularly with colors displayed on different screens and products manufactured using 3D printing.
We reserve the right to modify product designs, specifications, materials, colors, availability, and pricing at any time.
Certain Kinematek products are manufactured using 3D printing.
Because of the nature of 3D printing, minor cosmetic variations, layer lines, small surface imperfections, or slight variations in texture or finish may occur as part of the manufacturing process. These characteristics do not necessarily indicate a defect and do not affect the product’s intended fit, function, or performance.
A cosmetic variation that does not materially affect the product’s intended function is not, by itself, considered a manufacturing defect.
All orders are subject to product availability and acceptance by Kinematek.
Placing an order does not guarantee that the order will be accepted. We reserve the right to cancel or refuse an order when necessary, including when a product is unavailable, an obvious pricing or listing error occurs, or we reasonably suspect fraudulent or unauthorized activity.
If we cancel an order after payment has been received, we will issue a refund for the amount paid for the cancelled order.
Prices displayed on the Site are subject to change without notice.
Payment must be successfully received before an order is processed. Payments are processed through the payment providers made available during checkout.
Kinematek does not have access to your complete payment-card information when payment is processed through a third-party payment provider.
Kinematek currently ships physical products within the United States.
Estimated shipping or delivery times displayed on the Site are estimates and are not guaranteed unless expressly stated otherwise.
Once an order has been transferred to the applicable shipping carrier, delivery may be affected by circumstances outside Kinematek’s control, including carrier delays, weather, address issues, or other transportation disruptions.
Customers are responsible for providing an accurate shipping address at checkout.
If an order is returned to Kinematek because of an incorrect or incomplete address provided by the customer, additional shipping charges may apply before the order can be reshipped.
Refunds, replacements, and returns are governed by Kinematek’s Refund & Returns Policy, which is incorporated into these Terms by reference.
Physical products may qualify for a refund or replacement when they are defective, damaged during shipping, incorrect, or materially different from what was ordered, subject to the conditions and time limits described in that policy.
Digital products are generally non-refundable once accessed or downloaded, except where required by applicable law.

Kinematek products are intended to be used only for their designed and stated purposes.
Customers are responsible for using products appropriately and following any instructions, warnings, or recommendations provided with the product.
Kinematek phone cases are designed to provide protection for compatible mobile devices, but no phone case can guarantee that a device will never be damaged. Kinematek does not guarantee protection against every type of drop, impact, liquid exposure, extreme force, or other potential damage.
Customers should use reasonable care when handling and using products.
Kinematek products should not be used in situations where product failure could reasonably result in serious injury, death, or significant property damage.
All content on the Site, including but not limited to text, graphics, photographs, product designs, logos, videos, tutorials, CAD files, software, and other materials, is owned by Kinematek Enterprise LLC or its respective licensors unless otherwise stated.
You may not reproduce, redistribute, resell, publicly display, modify, reverse engineer, or create derivative works from Kinematek’s protected content or digital products without prior written permission, except where permitted by applicable law.
Purchasing a digital product does not transfer ownership of Kinematek’s underlying intellectual property.
Where Kinematek offers downloadable files, CAD resources, tutorials, or other digital products, the purchase provides the customer with the rights specifically granted with that product.
Unless otherwise stated, digital products are provided for personal use and may not be redistributed, resold, uploaded to another website, shared publicly, or otherwise commercially exploited without written permission from Kinematek.
If the Site allows users to submit reviews, comments, photographs, or other content, you are responsible for ensuring that your submissions do not violate the rights of others or applicable law.
By submitting content to the Site, you grant Kinematek a non-exclusive, royalty-free license to use, reproduce, display, and distribute that content in connection with operating and promoting the Site, subject to applicable law.
We reserve the right to remove content that we reasonably believe violates these Terms or applicable law.
To the fullest extent permitted by applicable law, the Site and its content are provided on an “as is” and “as available” basis.

To the fullest extent permitted by applicable law, Kinematek Enterprise LLC shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the use of the Site or products purchased through the Site.
To the fullest extent permitted by applicable law, Kinematek’s total liability arising from a particular purchase or transaction shall not exceed the amount actually paid by the customer for the product giving rise to the claim.
This limitation does not apply to liability that cannot legally be limited or excluded under applicable law.

The Site may rely on third-party services for payment processing, shipping, hosting, analytics, advertising, security, or other functions.
Kinematek is not responsible for the independent acts, omissions, policies, or availability of third-party services. Your use of third-party services may also be subject to their respective terms and policies.
We may suspend or terminate your access to the Site at our discretion if you violate these Terms or engage in conduct that may harm Kinematek, the Site, other users, or our products.
Termination does not affect provisions of these Terms that are intended to survive termination, including intellectual property, disclaimers, limitations of liability, and governing law.
We may update or modify these Terms from time to time.
When we make changes, we will update the “Last updated” date at the top of this page. Your continued use of the Site after updated Terms are posted constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law principles, except where applicable law requires otherwise.
